DAF, Iveco and other truck manufacturers have lost their appeal to the Court of Appeal of England and Wales against a judgment that deemed them legally bound by non-essential recitals of a 2016 EU cartel decision. The Court of Appeal ruled that the appeal of the truck manufacturers against an earlier decision by the Competition Appeal Tribunal should be dismissed. The judgment should be seen as a warning to companies combating damages actions arising from the European Commission’s antitrust decisions.
